Profile

Gary Letcher is a litigation partner at Edwards, Kenny & Bray LLP, and head of the firm’s environmental practice group. Mr. Letcher has been at the forefront of contaminated site and sustainability issues in Western Canada for over 20 years.

Mr. Letcher has acted for a range of clients on resource use issues, permitting issues, and corporate governance and compliance issues. He has acted on environmental and regulatory matters before all levels of Canadian courts and acted for the Mining Association of B.C. and AME B.C. in the Supreme Court of Canada Red Chris matter (January 21, 2010). He has acted as counsel in a number of complex contaminated site matters and appeared as lead counsel for the successful party in the B.C. Court of Appeal Seabright v. Imperial Oil decision (January 28, 2003). He has extensive experience advising on acid mine drainage issues and acted as lead counsel on behalf of a large multi-national in the dispute resolution surrounding the Britannia Mine contaminated site.
 
Mr. Letcher has appeared before a range of administrative tribunals and acted as lead counsel for the successful party on a number of significant matters before the Environmental Appeal Board including West Coast Reduction Ltd. v. District Director of the Greater Vancouver Regional District (March 8, 2010); Worthington MacKenzie Inc. v. Director Environmental Management Act (January 19, 2010); BC Rail Company v. Director of Waste Management and Nexen Inc. (March 3, 2004) and Canadian Occidental Petroleum Ltd. v. Director of Waste Management and B.C. Rail Company (March 20, 2001).
 
Mr. Letcher served as Commission Counsel to the Royal Commission into Uranium Mining in British Columbia and to B.C.’s Wilderness Advisory Committee. He is a frequent speaker to industry and to the profession and is recognized in PLC Which Lawyer, in The International Who’s Who of Business Lawyers, in Best Lawyers in Canada, in Lexpert and in Chambers Global, 2011 (www.chambersandpartners.com/Global/Editorial/40388) and was named the 2012 Vancouver Environmental Lawyer of the Year in Best Lawyers in Canada.
 
Mr. Letcher is a past National Chair of the Administrative Law section of the Canadian Bar Association and a past adjunct professor at the University of British Columbia Faculty of Law where he taught Resource Use Decision Making and Sustainable Development. He chaired the landmark City of Vancouver Task Force on Atmospheric Change, is a founding roster member of the Canadian Centre for Environmental Arbitration and Mediation and co-authored Contaminated Land Issues in British Columbia, 8 Canadian Journal of Administrative Law and Practice, 310, Carswell, Toronto. Mr. Letcher’s litigation practice has also involved shareholder actions including acting as lead counsel for the successful party in Lindzon v. International Sterling. He authored Corporate Governance and Oversight of Environmental Responsibilities.
