Edwards, Kenny & Bray LLP’s municipal law practice grew out of the firm’s reputation and successes in property development, administrative and regulatory law and construction law. With experience in zoning and development permit applications and before the trial and appellate courts of BC and the Supreme Court of Canada, EKB’s lawyers advise and represent clients in a wide range of matters related to local governments and municipal affairs.

Our lawyers have been members of the Urban Development Institute (UDI) and have been extensively involved with regulations under the BC Fish Protection Act including, in particular, the Streamside Protection Regulation, the Riparian Areas Regulation and the requirements under lower mainland stream setback bylaws and development permits.

EKB has also assisted clients on a variety of matters, including:

  • Representing clients before the BC Court of Appeal in actions concerning the validity of various municipal bylaws: Canadian Occidental Petroleum Ltd. v. North Vancouver and Save Richmond Farmland Society v. Richmond
  • Successfully challenging, in the BC Supreme Court,  a resolution by Delta requiring an owner to provide compensation or land as a condition of subdivision
  • Negotiating the resolution of a dispute over a local improvement levy concerning a trunk sewer servicing a large subdivision
  • Advising significant real property developers, including Genstar Development Company concerning amendments to official community plans and zoning bylaws and advising applications for development permits and subdivisions
