Brian is a solicitor with extensive experience in a broad range of corporate and commercial and securities law. He has specialized knowledge and expertise in complex securities and public and private merger and acquisition transactions, custom designed equity-based compensation plans and complex corporate and securities issues.
Gary A. Letcher recently presented at the British Columbia Ministry of the Environment Contaminated Sites Conference on March 8, 2013. Gary addressed rethinking the regulatory approach to contaminated sites in B.C., having in mind the last 20 years of experience and a modern application of sustainability/ comparative risk principles.
The partners of Edwards, Kenny & Bray LLP are pleased to welcome David E. Turner as a new partner of the firm. Mr. Turner joined EKB in 2006 after articling with the firm. Mr. Turner obtained a Bachelor of Arts degree from the University of Victoria in 2000 and a Bachelor of Laws degree from the University of British Columbia in 2005. He was called to the British Columbia Bar in 2006 after completing his articles at Edwards, Kenny & Bray LLP. Mr. Turner has a civil litigation practice with a focus on contract disputes, employment law, family law and wills and estates litigation.
David S. Allman and John D. McInnis of EKB’s Mining Law group recently attended the 2013 Prospectors and Developers Association of Canada Convention in Toronto, the world’s largest mining industry convention with over 30,000 registrants. John and David attended both as representatives of EKB’s Mining Law Group, and as EKB representatives of Globalmine, an international network of law firms which practice in the mining sector. David and John were pleased to see familiar faces, catch up with clients and friends, and make new acquaintances in the mining industry.
Congratulations to Jindy Bhalla on his recent appointment as a non-bencher member of the Law Society Audit Committee.
The Law Society Audit Committee assists the Benchers in determining that the financial affairs of the Society are properly managed by Law Society staff. This includes reviewing quarterly financial statements of the General, Liability Insurance and Special Compensation Funds prior to submission to the Benchers, providing an annual Audit Committee report to the Benchers and reviewing with the Law Society auditors their approach, the scope of their audit and the audit issue results.
Jindy’s appointment continues EKB’s long tradition of involvement with the Law Society of British Columbia.
The National Post features an article on the recent decision of the B.C. Supreme Court dealing with the interpretation of force majeure/act of god clauses. Edwards, Kenny & Bray LLP's Gary A. This case represents the first clear decision in Canada addressing the concept of "economic"ť force majeure in the absence of an express contractual term. On December 5, 2012, Andrea C. Akelaitis and Angela L. Folino presented at a Canadian Bar Association, Natural Resources subsection meeting on the topic of the December 2011 Domtar Inc. v Univar Canada Ltd. decision and its implications on the interpretation of force majeure clauses. Domtar v. Univar is the leading (and perhaps the only) authority in Canada for the proposition that there is no such thing as “economic” force majeure. Ms. Akelaitis and Ms. Folino both appeared as counsel for the plaintiff along with lead counsel, Gary A. Letcher.November 2012

The Lawyers Weekly has profiled the recent decision of the British Columbia Environmental Appeal Board in West Coast Reduction Ltd. v. Greater Vancouver (Regional District), which concerned a challenge to the use of odour units as a standard of measurement for permitting purposes.
