April 2013

EKB welcomes Brian Vick who joins the firm as associate counsel and senior solicitor after having practiced at a major and national law firm in Vancouver for more than thirty years.

Brian is a solicitor with extensive experience in a broad range of corporate and commercial and securities law. He has specialized knowledge and expertise in complex securities and public and private merger and acquisition transactions, custom designed equity-based compensation plans and complex corporate and securities issues.

The respected Chambers Global 2013 world lawyer rating directory, released March 15, 2013, lists Edwards, Kenny & Bray LLP’s “highly experienced” partner David S. Allman for his mining law work in Latin America and EKB partner Gary Letcher as a “highly rated” noted practitioner in Environmental Law.

Gary A. Letcher recently presented at the British Columbia Ministry of the Environment Contaminated Sites Conference on March 8, 2013. Gary addressed rethinking the regulatory approach to contaminated sites in B.C., having in mind the last 20 years of experience and a modern application of sustainability/ comparative risk principles.

The partners of Edwards, Kenny & Bray LLP are pleased to welcome David E. Turner as a new partner of the firm. Mr. Turner joined EKB in 2006 after articling with the firm. Mr. Turner obtained a Bachelor of Arts degree from the University of Victoria in 2000 and a Bachelor of Laws degree from the University of British Columbia in 2005. He was called to the British Columbia Bar in 2006 after completing his articles at Edwards, Kenny & Bray LLP. Mr. Turner has a civil litigation practice with a focus on contract disputes, employment law, family law and wills and estates litigation.

David S. Allman and John D. McInnis of EKB’s Mining Law group recently attended the 2013 Prospectors and Developers Association of Canada Convention in Toronto, the world’s largest mining industry convention with over 30,000 registrants. John and David attended both as representatives of EKB’s Mining Law Group, and as EKB representatives of Globalmine, an international network of law firms which practice in the mining sector. David and John were pleased to see familiar faces, catch up with clients and friends, and make new acquaintances in the mining industry.

Edwards, Kenny & Bray LLP's is pleased to announce that three of our lawyers, Gary Letcher, John McInnis and David Allman, are named as leading practitioners in their areas of practice in Who’s Who Legal: Canada 2012. Gary Letcher is recognized as a leading practitioner in environment law and for his experience in advising on contaminated sites, acid mine drainage and sustainability issues. John McInnis and David Allman are named as leading practitioners in the area of mining law. John McInnis is recognized for his work on high profile negotiations for joint ventures relating to mineral exploration. David Allman is recognized for his work on advising clients of all levels on domestic and international mining issues.


January 2013

Congratulations to Jindy Bhalla on his recent appointment as a non-bencher member of the Law Society Audit Committee.

The Law Society Audit Committee assists the Benchers in determining that the financial affairs of the Society are properly managed by Law Society staff. This includes reviewing quarterly financial statements of the General, Liability Insurance and Special Compensation Funds prior to submission to the Benchers, providing an annual Audit Committee report to the Benchers and reviewing with the Law Society auditors their approach, the scope of their audit and the audit issue results.

Jindy’s appointment continues EKB’s long tradition of involvement with the Law Society of British Columbia.


December 2012

On December 5, 2012, Andrea C. Akelaitis and Angela L. Folino presented at a Canadian Bar Association, Natural Resources subsection meeting on the topic of the December 2011 Domtar Inc. v Univar Canada Ltd. decision and its implications on the interpretation of force majeure clauses. Domtar v. Univar is the leading (and perhaps the only) authority in Canada for the proposition that there is no such thing as “economic” force majeure. Ms. Akelaitis and Ms. Folino both appeared as counsel for the plaintiff along with lead counsel, Gary A. Letcher.

November 2012

Edwards, Kenny & Bray LLP's Saravan J. Veylan was elected as a director of the Vancouver Bar Association on November 22, 2012. Mr. Veylan will sit as an at-large director on the Association’s executive committee.

March 2012

Edwards, Kenny & Bray LLP's Geoffrey M. Sherrott recently chaired the B.C. Continuing Legal Education Society course on Securities Law Fundamentals 2012. Mr. Sherrott also presented the "Corporate Law Primer" at the course. This is the fourth year that Mr. Sherrott has chaired and presented at the Securities Law Fundamentals course for CLE. Mr. Sherrott advises private and public companies on a wide range of corporate and commercial issues and has particular experience in dealing with securities issues.

The National Post features an article on the recent decision of the B.C. Supreme Court dealing with the interpretation of force majeure/act of god clauses. Edwards, Kenny & Bray LLP's Gary A. Gary A. Letcher and Thomas Clarke jointly authored and presented their paper, "Liability for Contaminated Sites: An Update on Response and Resolution Strategies" at the 6th Edition of the Insight Conference on Environmental Law in B.C.


Gary Letcher, Andrea Akelaitis and Angela Folino acted for the successful party in a December 23, 2011 significant British Columbia Supreme Court case concerning the interpretation of a force majeure clause in a long term commodity supply contract. This case represents the first clear decision in Canada addressing the concept of "economic"ť force majeure in the absence of an express contractual term. The Lawyers Weekly has profiled the recent decision of the British Columbia Environmental Appeal Board in West Coast Reduction Ltd. v. Greater Vancouver (Regional District), which concerned a challenge to the use of odour units as a standard of measurement for permitting purposes. Gary Letcher and Andrea Akelaitis of the Edwards, Kenny & Bray Environmental Law Practice Group acted for the successful appellant in that case challenging the use of odour units that had been imposed into a permit by Metro Vancouver.
