EKB has assisted clients on a variety of legal matters involving a wide range of products, including bio-medical products, insecticides and chemicals, asbestos products, construction materials, apparatus and tools, and aircraft, aircraft engines and components. Notable cases include:

• Successfully resisting an application in the BC Supreme Court for class certification of claims against The Dow Chemical Company and to have the claims struck out.
• Successfully acting as lead counsel in the defence of approximately 1,000 actions resulting from the use of an insecticide manufactured by Dow Agrosciences LLC.
• Acting as lead counsel in the successful defence of third party claims against Dow Agrosciences LLC with respect to allegedly toxic carpet coatings.
• Representing a large international mining company in a wide variety of cases, including defence of claims in the Philippines from citizen groups and governmental authorities, as well as the preparation and presenting of claims against insurers arising from the escape of mine tailings. None of the claims faced by our client has been successfully prosecuted. 
• Representing the Flintkote group of companies in complex subrogated actions brought by the Workers’ Compensation Board (WCB) for monies paid to individuals who allegedly suffered personal injuries as a result of exposure to asbestos.
• Representing Honeywell Inc. in defence of a claim involving alleged defects in the design of an automatic flight control system installed in helicopters.
• Representing Eurocopter in the defence of, and settling, claims for wrongful death allegedly resulting from faulty design of helicopter fuel management systems.
